Report: Heatley Refuses To Waive No-Trade Clause

Now, it gets interesting.

Dany Heatley did not waive his no-movement clause to facilitate an agreed-upon trade between the Ottawa Senators and Edmonton Oilers that would have sent Andrew Cogliano, Dustin Penner and Ladislav Smid to Ottawa.

For now, and quite possibly forever, the deal is dead.

The good news for the Senators is that the NHL said that the bonus payment to Heatley doesn’t have to be paid until midnight tomorrow so technically they still have 24 hrs still to trade him without having to pay the bonus of 4 million.

Its not clear if Heatley refused the trade or failed to respond in sufficient time.  Its hard to believe that the Oilers and Senators would have progressed this far without knowledge that they could get a deal done.

Update:  Apparently he is going to sleep on it as his agent told Sportsnet.

Heatley’s agent J.P. Barry told Sportsnet.ca late Tuesday night that “it is our position that the [bonus] deadline is not until [Wednesday] night. We believe the [trade] decision does not have to come until that time…  Dany is going to sleep on it.”
